Apple suffers legal setback in Germany

The Munich Regional Court rejected Apple Inc's plea of imposing a ban on the sales of Samsung Electronics' Galaxy 10.1N and Galaxy Nexus' mobile phone in Germany on Wednesday.
The decision was announced a day after a Dusseldorf appeals court upheld Apple's request to ban the sales of Samsung’s Galaxy Tab 10.1.
Apple and Samsung have been locked in a legal battle spanning various countries as both try to get a bigger share of the booming smartphone and tablet market. Apple had accused Samsung of "slavishly" copying its patents. Apple claimed that Samsung’s Galaxy devices copied the patents of its popular iPhone and iPad.
The European Commission had on Tuesday announced that it will investigate whether Samsung broke a 1998 commitment to license any standard essential patents for phones on "fair, reasonable and non-discriminatory terms."
Presiding Judge Andreas Mueller while delivering the ruling stated that Samsung had proven that it is more likely than not that the patent will be revoked as the technology concerned was already on the market before the intellectual property had been filed for protection.
